Abstract (English):
During the pandemic, the problem of bankruptcy of enterprises became particularly relevant, as due to the introduction of restrictive measures, many companies lost their income, as a result of which they could no longer fulfill their obligations to creditors. Thus, this article will consider the concept and essence of the term "bankruptcy", as well as the features of bankruptcy during the pandemic

Впервые с проблемой  банкротства столкнулись в послевоенный период, когда Вторая Мировая Война была завершена. Главной причиной роста количества предприятий потерпевших банкротство стало то, что с окончанием войны перестали поступать и военные заказы. Именно в этот период выросла актуальность задачи определения условий ведущих предприятие к несостоятельности, а также распознание ее ранних симптомов.

Так что же такое банкротство? 

Можно встретить несколько понятий слова «банкротство».  Например, по мнению, О.В. Раевской, слово «банкротство» происходит от французского «banqueroute» (пер. – банкротство).  А некоторые исследователи, такие как Райзберг Б.А., Лозовский Л.Ш., Стародубцева Е.Б. считают, что основа слова «банкротство берет с начала еще XVI века и происходит от итальянского «bancorotto», что в переводе на русский означает «поломанный стол» . По историческим данным, купцы-кредиторы ломали столы несостоятельных денежных менял, занимавшихся финансовыми операциями в средневековой Италии.

«В русском языке «банкротство» в буквальном смысле слова понимается как а) «разорение, которое приводит к несостоятельности, делающее банкротом», то есть лицом не состоятельным, тем «кто оказался не в состоянии выполнить возложенные на него или принятые на себя обязательства»; б) «несостоятельность, сопровождающаяся прекращением платежей по долговым обязательствам»; в) «несостоятельность, отсутствие  у должника финансовой возможности отвечать по своим долговым обязательствам». Наиболее важной характеристикой банкротства выступает неспособность должника выполнять свои долговые обязательства.»

В науке банкротство предприятий можно интерпретировать поразному. Например, можно выявить отличия между экономической и юридической трактовками. Также банкротство предприятия можно рассматривать не только как состояние, но и как процесс. Особенность юридической трактовки банкротства заключается в том, что ее связывают с нормативными определениями банкротства, активов, обязательств и возможности восстановления платежеспособности. Признать предприятие банкротом можно только исключительно по решению арбитражного суда. Зачастую, более важное значение имеют юридические признаки банкротства, нежели фактическое финансовое состояние предприятия. 

Что в прошлом, что в настоящее время, проблема банкротства предприятий все еще актуальна. Особенно остро данная проблема встала в период пандемии. 

Распространение коронавирусной инфекции оказало серьезное негативное влияние как на мировую, так и на российскую экономику. В связи с введением режима самоизоляции весной 2020 года свою деятельность временно остановили отели и гостиницы, туристические копании, предприятия общественного питания, салоны красоты и т.п. По этой причине многие организации оказались на грани банкротства. 

Основной причиной банкротства в период пандемии стала невозможность компаний выполнять свои долговые обязательства по банковским кредитам. Большая часть организаций и так крайне закредитована, именно поэтому сокращение дохода или его полное отсутствие в период введения ограничительных мер лишили организации возможности осуществлять кредитные платежи.

На тот момент, по предварительным оценкам, наиболее серьезно, от введения карантина пострадали предприятия восьми отраслей:

1. Транспорт;
2. Гостиничная и торговая недвижимость;
3. Сфера услуг;
4. Производство строительных материалов;
5. Оптовая и розничная торговля товарами выборочного спроса;
6. Образование;
7. Спорт;
8. Деятельность учреждений культуры и искусства;

Все эти сферы связаны работой непосредственно с людьми. Поэтому в период изоляции их деятельность была ограничена в первую очередь, что повлекло за собой довольно таки большие убытки, а как следствие привело и к несостоятельности организаций. 

В связи с таким положением вещей условия кредитования компаний, особенно компаний с высоким уровнем производительности, стали более лояльными. 

В период пандемии изменились не только условия кредитования, но и в качестве одной из мер поддержки в период распространения коронавирусной инфекции был объявлен мораторий на банкротство.  

Как показала практика, в ведении моратория на банкротство для кредиторов нет никаких положительных сторон, когда у должников имеется целый перечень таковых:

• Лишь должник имеет право  обратиться с заявлением о признании себя банкротом, кредитор же такого права не имеет. 
• Кредитор не имеет права обратить взыскание на заложенное имущество должника, которое было заложено в  период действия моратория.
• Приостанавливается исполнительное производство по имущественным взысканиям по требованиям, возникшим до введения моратория. Некоторые компании, которые вышли из-под моратория прибегли к следующей схеме: они сначала массово приостановили всё исполнительное производство в отношении себя и только потом обратились с заявлением об отказе от моратория.  
• Прекращается начисление неустойки. Исключением являются обязательства, которые возникли в период действия моратория. То есть на время действия моратория на банкротства должники получают право нарушать свои обязательства, и никакие санкции по договору на них не будут  распространяться. Более того, Верховным судом было дано разъяснение, что и санкции пост. 395 ГК РФ(за пользование чужими денежными средствами) также не будут  распространяться на мораторных должников.
• Не привлекаются к субсидиарной ответственности контролирующие должника лица в связи с неподачей заявления о признании должника банкротом, в случае объективного банкротства должника, возникшего в период банкротства.
• Не привлекается к административной ответственности руководитель должника в случае объективного банкротства должника, возникшего в период банкротства.

Помимо преимуществ есть и ограничения, которые служат препятствием для вывода активов:

• Невозможность удовлетворения требований учредителей, когда они пытаются выйти из состава акционеров или участников общества и забрать свою долю деньгами.
• Невозможность прекращения денежных обязательств должника путем зачета встречного однородного требования в нарушение очередности.
• Невозможность изъятия собственником имущества должника — унитарного предприятия принадлежащего должнику имущества.
• Невозможность выплаты дивидендов, паевых доходов.

Таким образом, можно сделать вывод, что банкротство – это признанная уполномоченным на то органом, неспособность должника в полном объеме отвечать по всем своим кредитным обязательствам. Признать компанию банкротом можно только по решению арбитражного суда, а мораторий на банкротство, принятый как мера поддержки в период пандемии, имеет положительный характер в большей степени для должников, нежели для кредиторов.
