Abstract (English):
A crime is any act or omission in the process of breaking a law prohibiting an act or omission. This article will analyze the object of the crime from the point of view of one of the criteria underlying the construction of the system of institutions of the Special Part of Criminal Law

В отличие от гражданского права, уголовное право - это правовая система, которая наказывает правонарушителей. Следовательно, если два человека ставят под сомнение их права в гражданском деле, обвинение включает решение правительства наказать этого человека за его действия или бездействие.

Преступление - это предусмотренное уголовным законом общественно опасное деяние (действие или бездействие), посягающее на общественный строй, политические или экономические системы, собственность, личность, политические, трудовые, имущественные и другие права и свободы граждан, а равно иное, посягающее на правопорядок, общественно опасное деяние, предусмотренное уголовным законом.

Большинство современных высказываний об институтах  Особенной части уголовного права объединяет представление о том, что они выделяются на основании такого критерия, как объект уголовно-правовой защиты.  В связи с этим появляется обоснованная острая необходимость построения  системы институтов  Особенной части с учетом и  через призму учения  об объекте преступления. Здесь,  в первую очередь,  необходимо выяснить вопрос о количестве объектов охраняемых уголовным законом, а также о количестве институтов  Особенной части уголовного права.
В целом партноменклатура всех объектов защищена Уголовным кодексом, приведенными в ч. 1 ст. 2 УК РФ признает права и свободы человека и гражданина, собственность, общественный порядок и общественную безопасность, окружающую среду, конституционный строй Российской Федерации, мир и безопасность человека. Однако если сравнить перечень охраняемых объектов в заголовках глав особого раздела УК РФ в высокоспециализированной научной литературе, то неоднократно отмечалось, что он является полным и безупречным. Такое положение нельзя считать нормальным.

Принципиальную важность конкретного круга охраняемых уголовным законом отношений сложно недооценить как для  установления пределов уголовно-правового регулирования,  так и для решения  более частных вопросов систематизации институтов Особенной части уголовного права. Именно из-за этого происходит так, что большинством ученых-юристов  предлагается дополнить и  расширить перечень объектов уголовно-правовой  охраны в ч. 1 ст. 2 УК РФ. Но формулируя новую редакцию  данной нормы,  авторы сохраняют существующий прием,  предполагающий закрытый перечень таких объектов. 

Очень трудно недооценить основательное значение объема конкретных законодательных отношений будь то для установления границ уголовно-правовой системы или решения более конкретных проблем преобразования особой части уголовного права. В связи с этим некоторые ученые-правоведы предложили дополнить и расширить перечень объектов, которые охраняются уголовным законодательством в части 1. статья 2 Уголовного кодекса Российской Федерации. Но при формулировании новой версии спецификации, автор сохранил существующий метод, основанный на закрытом списке таких объектов.

Если рассмотреть некоторые положения институтов крайней необходимости в странах англо-саксонской системы права, то в первую очередь, необходимо отметить, что понимание «крайней необходимости» тесно связано с «вынуждением». Подобная система, как рассматривалось выше, существовала и в Уложении 1845года. В отличие от российского уголовного законодательства, крайняя необходимость в иностранной системе является способом защиты, при доказывании которой суд по данному основанию может оправдать лицо. Видно, что перечисление конкретных объектов уголовно-правовой защиты в вышеизложенном кодексе сочетает в себе выражение «личных, социальных и национальных прав и законных интересов» в широком смысле. В противном случае ответственность несет лицо, причинившее неоправданное телесное повреждение, но судья может смягчить силу наказания. Обращение к зарубежному судебному законодательсву при управлении чрезвычайными ситуациями как исключение поведенческих преступлений разрешает нам формулировать рекомендации по соответствующему российскому законодательству. В современных же условиях Россия и другие страны объединили усилия в борьбе с преступной деятельностью, и если они понимают разные системы уголовного права и имеют к ним соответствующее отношение, те же методы могут использоваться для решения проблем в сфере уголовной политики. Национальная система  права имеет универсальные характеристики, закономерности и тенденции. В это же время очевиден тот факт, что механический перенос иностранного опыта в страну не работает, хотя действующие принципы интеграции Российской Федерации в европейскую правовую систему вынуждены его использовать. Применение  законодательного метода выглядит многообещающим, поскольку он обеспечивает «открытый вход» во внешнюю социальную среду для институциональной системы специализированных ведомств и формирует эту систему под его влиянием. Это очень важно в современных условиях, потому что социальная жизнь и общественные стандарты быстро входят в «мобильное» состояние. Следует выделить, что система специальных редакций уголовного права всегда является исчерпывающей, и изначально она определялась аналогией законности уголовного закона и принципа запрета применения. Построить специализированную систему уголовного права на основе объекта курса и принять за стандарт системы  выбранного объекта. Тут речь идет именно о взаимосвязи системы специальных ведомств и так называемой «вертикальной» классификации криминальных объектов. Традиционно было много споров и не было однозначного решения. Проанализировав  данную ситуацию, Ю. Пудовочкин  заявил, что «Современная система особенной части отечественного уголовного законодательства не позволяет установить универсальную вертикальную классификацию криминальных объектов; а также отсутствие единого понимания вертикальной классификации объектов. Невозможно воссоздать целостную систему, состоящую из различных частей уголовного права». Однако весь смысл этой классификации как раз состоит в том, чтобы обеспечить внутренне непротиворечивую систему объектов защиты уголовного права и соответствующих положений уголовного права.

В целом, в нашем понимании вертикальная классификация объектов включает прямые объекты, конкретные объекты, общие объекты и обычные объекты. Учитывая, что первая часть УК РФ является основным внешним проявлением уголовно-правовой системы, особую часть уголовно-правовой системы целесообразно представить как совокупность разъяснений по уголовной ответственности. Единый универсальный объект входит в систему действия главы уголовного права. Все же следует сказать, что это не предмет правоприменения, а особая часть сложной уголовно-правовой системы. Без подробного обсуждения того, какой объект является субъектом  и отражающим социальную природу посягательства в этом случае, позиция законодателя все же должна быть поддержана и законодатель должен принять во внимание при определении объекта посягательства направление намерения и цели поведения преступника. Именно такая позиция позволяет нам увидеть социальные ценности, которыми руководствуются преступники. Кроме этого, она же оправдывает законодательные решения, к примеру, нормы об ответственности за посягательство на жизнь государственного или общественного деятеля — в главу о преступлениях против государственной безопасности; нормы об ответственности за уничтожение военного имущества — в главу о преступлениях против военной службы и т. В связи с этим нельзя не согласиться с тезисом В. Плоховой о необходимости переоценить основные цели особых нарушений и все специальные нормы перенесены в главы, основанные на различных общих задачах. В то же время приведенное выше утверждение не может отрицать того факта, что законодатели иногда не могут точно оценить правильное содержание общего объекта того или иного преступления. В целом, перенос некоторых положений особенной части УК РФ из одной главы в другую является правильным и теоретически обоснованным. Однако это не отрицает общий вывод о том, что законодатели в целом полностью понимают социальную природу преступлений, которые они определяют, и создали достаточную систему уголовного права.

По результатам исследования сделан вывод о том, что законодатель в целом полностью осознавал социальную природу осуждаемого им поведения и установлена ​​система отдельных частей Уголовного кодекса Российской Федерации, применимых к уголовному праву.
